Divorce in Oregon | What to Expect

The litigation process in Oregon follows a somewhat predictable path. Here are the basic steps you can expect during your divorce:

Start the Process
  • Hire a divorce attorney.
File a Petition for Dissolution of Marriage
  • Your lawyer will help you prepare and file for a Dissolution of Marriage that meets all the legal requirements.
Wait Up to 30 Days for a Response
  • Your spouse must respond within 30 days.
  • Negotiations, mediation, and even court may be required at this stage to settle outstanding issues like child support, alimony, and dissolution of property.
Finalize the Divorce
  •  A judge will sign the final Dissolution of Marriage and rule on any remaining issues.
  • The length of this final stage can take several weeks or several months, depending on the complexity of your case.

Mediation

Mediation is a way to resolve disputes respectfully without going to court. Mediation is required for nearly all family law cases, with few exceptions. At Laidlaw & Laidlaw, we have skilled mediators that help address all types of cases. We help parties identify specific problems, communicate their concerns, and find common ground to reach a voluntary agreement.
